As a consultant, we determine what the Ontario Building Code (OBC) deficiencies are; and what the best solutions are to have them rectified. It could be dealing with the builder, Building Inspector, the municipality or Tarion (protecting new home buyers), in some cases even Professional Engineers.

Lawyers are expensive and generally don’t have the expertise in the construction industry required. We may work with your lawyer or ‘problem solve’ before it gets that far; if it does, we may be a qualified witness. Our goal is to ensure the construction complies with at least minimum standards and all applicable law.

We have helped new homeowners deal the builder to correct deficiencies that just couldn’t wait the sometimes lengthy process of Tarion. Insufficient insulation has been found in new homes as well as structural issues. We have even discovered a new deck that projected beyond the property line.

Our consultants have even discovered a case where the contractor didn’t use the approved permit drawings, the rear addition and second storey no longer resembled the original project. The location of the walls no longer complied with the zoning by-law and a variance through the Committee of Adjustment was required. This was due to the contractor not understanding the protocol and procedures when changes are made; along with changes the owners wanted and the contractor building whatever he wanted.

When changes are made to the project the Designer is to be notified to ensure the OBC is followed and the by-laws are in compliance. A revision to the approved drawings may be required. The contractor may make structural changes based on their experience but each situation must be evaluated on its own criteria. Calculations and whether the proposal is acceptable must be verified for compliance.

The Ministry of Municipal Affairs and Housing, (MHMA), implemented a new law BILL 124, in January 2006. This law requires designers and practitioners to have extensive knowledge of the OBC and construction to pass courses and exams to allow them to prepare drawings as Qualified Designers. A person preparing drawings can’t use the title Designer unless they are a Qualified Designers with a thorough knowledge of the OBC.

Some cases we have dealt with were due to the Qualified Designer not doing their due diligence by confirming the zoning by-law or applicable law requirements. The design was not able to be approved as designed and drawings were required.
